These Terms and Conditions apply to all bookings and use of the sauna and/or ice bath facilities provided by Kasumii ("we", "us", "our") at our home-based premises in Western Australia.

By making a booking, paying for a booking, or using our facilities, you agree to these Terms and Conditions.

1. Booking and Payment

1.1 Bookings are subject to availability and are only confirmed once payment has been received, unless otherwise agreed by us in writing.

1.2 Prices are those displayed or quoted at the time of booking and may be changed by us for future bookings.

1.3 Payment must be made using the payment method specified at the time of booking.

1.4 You must provide accurate contact information when making a booking.

1.5 Bookings are for the person who made the booking and the number of guests stated at the time of booking. You must not allow additional people to use the facilities without our prior approval.

1.6 We reserve the right to refuse or cancel a booking where we reasonably believe the facilities may be used unsafely, unlawfully, contrary to these Terms and Conditions, or in a manner that may cause damage to people or property.

2. Arrival and Session Times

2.1 Customers must arrive at the agreed booking time.

2.2 Your booking period includes your allocated session time. Late arrival does not generally entitle you to an extension or refund due to subsequent bookings.

2.3 Customers must leave the premises promptly at the end of their allocated booking.

2.4 We may charge additional fees where a customer remains on the premises beyond their allocated time without our approval.

2.5 As this is a home-based business, customers must respect the residential nature of the premises, surrounding neighbours and any reasonable instructions provided by us.

3. Sauna and Ice Bath Use

3.1 The sauna and ice bath are provided for recreational and wellness purposes only.

3.2 Customers must follow all safety instructions, operating instructions and directions provided by us.

3.3 Customers must not use the sauna or ice bath while under the influence of alcohol, recreational drugs or any substance that may impair judgement, coordination or awareness.

3.4 Customers must not engage in dangerous, reckless, disruptive or inappropriate behaviour.

3.5 Customers must not tamper with, alter, move, disconnect or interfere with any sauna, ice bath, electrical, plumbing, temperature-control or safety equipment.

3.6 Customers must immediately notify us of any equipment malfunction, damage, injury, illness or other safety concern.

3.7 Minimum age requirements for use of the sauna or ice bath – participants must be over 18 years of age.

3.8 Customers must comply with any maximum occupancy limits specified by us.

4. Health and Medical Considerations

4.1 Sauna and cold-water immersion can place significant physiological stress on the body and may not be suitable for everyone.

4.2 You are responsible for determining whether sauna or ice bath use is appropriate for you.

4.3 You should seek medical advice before using the sauna or ice bath if you have any medical condition, take medication, are pregnant, have concerns about your cardiovascular health, blood pressure, circulation or ability to safely tolerate heat or cold, or are otherwise unsure whether these activities are suitable for you.

4.4 You must not use the facilities if you are unwell or experiencing symptoms that may make sauna or cold-water immersion unsafe.

4.5 Our staff or representatives are not medical professionals and do not provide medical advice, diagnosis or treatment.

4.6 You must immediately stop using the sauna or ice bath if you feel faint, dizzy, confused, excessively weak, short of breath, unwell or otherwise unsafe.

4.7 If an emergency occurs, you should contact emergency services immediately.

5. Personal Responsibility and Supervision

5.1 You use the sauna and ice bath voluntarily and are responsible for using the facilities in accordance with the instructions provided.

5.2 Customers should never exceed their own reasonable tolerance for heat or cold.

5.3 We recommend that customers do not undertake sauna or ice bath sessions alone where doing so may create a safety risk.

5.4 Customers must advise us before their session of any relevant safety concern that may reasonably affect their ability to use the facilities safely.

6. Hygiene

6.1 Customers must follow all hygiene requirements provided by us.

6.2 Customers must shower before entering the ice bath where requested.

6.3 Appropriate swimwear must be worn in the ice bath.

6.4 Customers must use towels or other protective measures as instructed when using the sauna.

6.5 Customers must not bring food, glass containers or other prohibited items into the sauna or ice bath area.

6.6 Customers must leave the facilities in a clean and reasonable condition.

6.7 Excessive cleaning, contamination or sanitation caused by misuse may result in an additional cleaning fee, subject to applicable law.

7. Alcohol and Drugs

7.1 Alcohol and recreational drugs must not be consumed before or during use of the sauna or ice bath.

7.2 We may refuse access to any person who appears intoxicated or impaired.

7.3 If access is refused for this reason, the booking may be treated as a customer cancellation and the applicable cancellation terms will apply, subject to your rights under Australian Consumer Law.

8. Damage to Property

8.1 Customers are responsible for taking reasonable care of the premises, equipment and property provided for their use.

8.2 Customers may be responsible for reasonable costs associated with damage caused by their intentional, reckless or negligent conduct, except to the extent that liability cannot lawfully be imposed.

8.3 We will provide reasonable details of any claimed damage and associated costs.

8.4 Normal wear and tear will not be charged to customers.

9. Personal Belongings

9.1 Customers are responsible for their personal belongings.

9.2 We are not responsible for loss, theft or damage to personal property brought onto the premises, except where liability cannot lawfully be excluded or limited.

10. Cancellation by the Customer

10.1 We understand that plans can change. Customers may cancel a booking by contacting us using the contact details provided above.

10.2 Unless otherwise stated at the time of booking, the following cancellation policy applies:

  • More than 24 hours before the booking: full refund or, at the customer's choice, transfer of the booking to another available time.

  • Between 12 and 24 hours before the booking: 50% refund or transfer of the booking to another available time.

  • Less than 12 hours before the booking: no refund will generally be provided, and the booking may not be transferable.

  • Failure to attend ("no-show"): no refund will generally be provided.

10.3 We may, at our discretion, waive or reduce a cancellation fee where there are exceptional circumstances.

10.4 Cancellation fees will not apply to the extent that their application would be inconsistent with a customer's rights under the Australian Consumer Law or other applicable law.

11. Rescheduling

11.1 Subject to availability, customers may request to move their booking to another time.

11.2 Rescheduling requests must be made as soon as reasonably possible.

11.3 A booking may generally be rescheduled once without an additional fee if sufficient notice is provided.

11.4 Repeated rescheduling or requests made at short notice may be treated as a cancellation and rebooking.

12. Cancellation or Closure by Us

12.1 We may cancel, postpone or reschedule a booking where reasonably necessary, including because of:

  • equipment failure;

  • maintenance or cleaning requirements;

  • unsafe conditions;

  • power, water or other utility failure;

  • extreme weather;

  • illness or emergency;

  • damage to the premises or equipment;

  • circumstances outside our reasonable control; or

  • any other situation where continuing the booking may create a safety risk.

12.2 Where we cancel a booking for reasons within our control, we will generally offer the customer a choice of a full refund or reasonable alternative booking.

12.3 Where a booking cannot safely proceed because of circumstances outside our reasonable control, we will work with the customer to provide a reasonable alternative, refund or rescheduling option where appropriate.

12.4 Nothing in this section limits any rights the customer may have under the Australian Consumer Law.

13. Our Responsibility

13.1 We will provide the services with due care and skill and in accordance with applicable consumer guarantees.

13.2 We will take reasonable steps to maintain the facilities in a safe and suitable condition.

13.3 Customers must follow all reasonable safety instructions provided by us.

13.4 To the extent permitted by law, customers are responsible for losses arising from their own failure to follow safety instructions, misuse of the facilities, reckless behaviour or failure to disclose relevant information that they reasonably should have disclosed.

13.5 Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot legally be excluded, restricted or modified.

14. Australian Consumer Law

14.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

14.2 For major failures with the service, you may be entitled:

  • to cancel your service contract with us; and

  • to a refund for the unused portion, or compensation for its reduced value.

14.3 You may also be entitled to compensation for other reasonably foreseeable loss or damage.

14.4 If a failure does not amount to a major failure, you may be entitled to have the problem rectified within a reasonable time and, if it is not rectified, to cancel the service and obtain a refund for the unused portion.

14.5 Nothing in these Terms and Conditions is intended to remove or reduce those statutory rights.

15. Privacy

15.1 We may collect personal information necessary to process bookings, communicate with customers, administer payments, maintain safety and operate the business.

15.2 We will handle personal information in accordance with applicable privacy laws and our privacy practices.

15.3 Customers should not provide unnecessary sensitive or medical information unless it is relevant to the safe provision of the service.

16. Photography and Recording

16.1 Customers must not photograph, film or record other customers or persons at the premises without their consent.

16.2 We will not use identifiable customer photographs or videos for marketing purposes without appropriate permission.

17. Right to Refuse or End a Session

17.1 We may refuse access to or end a session where we reasonably believe a customer:

  • is intoxicated or impaired;

  • is behaving dangerously or abusively;

  • is failing to follow safety instructions;

  • is damaging property;

  • is creating a safety risk to themselves or others; or

  • is materially breaching these Terms and Conditions.

17.2 Where reasonably possible, we will explain the reason for ending or refusing a session.

17.3 Any refund will be considered having regard to the circumstances and the customer's rights under applicable law.

18. Changes to These Terms

18.1 We may update these Terms and Conditions from time to time.

18.2 The Terms and Conditions applying to a booking will generally be those accepted by the customer at the time of booking, unless a change is required by law.

19. Governing Law

19.1 These Terms and Conditions are governed by the laws of Western Australia and applicable Commonwealth laws of Australia.

19.2 Any dispute will be dealt with in accordance with applicable Australian law.

 

20. Acceptance

By making a booking or using our sauna or ice bath facilities, you acknowledge that you have read, understood and agreed to these Terms and Conditions.
